This Legal Notice describes the terms and conditions governing the use of this website: www.dulcolax.com.my, including without limitation information, videos, content and/or website directly provided by DKSH Malaysia Sdn. Bhd. (collectively hereinafter the “Site”). By accessing the Site, you agree to be bound by these terms and conditions. Please read these terms and conditions carefully.

This Legal Notice and any terms and conditions thereof may be amended at any time, without prior notice, we advise you to consult them regularly.

The Site and its contents are designed to comply with Malaysian laws and regulations. Although accessible by others, it and its content are intended for access and use by Malaysian residents only.

Intellectual property

The Site is owned and operated by DKSH Malaysia Sdn. Bhd. (“DKSH”, “we” or “us”). The layout and each of the components, including – but not limited to – designs, trademarks and logos, appearing on the Site, are protected by current laws on intellectual property, and belong to DKSH or its affiliated companies, or their use is the subject of authorisation from third party.

No component of the Site may be copied, reproduced, altered, edited, downloaded, denatured, transmitted or distributed in any way whatsoever, on any medium whatsoever, in whole or in part, without the prior written consent of DKSH, except solely for use for press requirements conditional on compliance with intellectual property rights and any other property rights that are mentioned. Copying for private use is only authorised for your own personal, private, non-commercial use, on your personal computer.

The following statement should appear on any authorised copy of all or part of the content of the Site:

Any authorised use of items composing or shown on the Site must not be denatured, changed or altered in any way whatsoever. Any licence granted by DKSH hereunder is only authorised subject to (i) the intellectual property rights of DKSH and/or its affiliates being complied with and nothing shall be done to undermine or prejudice such intellectual property rights, and (ii) compliance with all applicable laws.

DKSH or its affiliated companies reserve the right to take legal action against any breach of its intellectual property rights.

Nature of information

In general, the Site provides information about constipation, health information and DKSH’s products as registered and approved by the relevant authorities in Malaysia. While DKSH will use its best efforts to keep the information provided by DKSH via the Site accurate and up to date, no express or implied warranty or representation is made that the information is complete and accurate.

The Site may offer opinions by experts in a particular field in relation to the content of the Site or excerpts from press articles or publication. Any such information solely represents the experts’ personal opinion or the publication, and is not necessarily the opinion of DKSH or the DKSH Group. Any such experts are not employees of DKSH or the DKSH Group and do not receive any emoluments in exchange for DKSH using their opinion. DKSH is not responsible for the accuracy or completeness of any such information and opinions.

The Site may also include information on health, physical condition, the medical field and medical treatments for human use. Said information is published on the Site for informational purposes only and is no substitute for the advice of your physician or pharmacist. The information should not be used under any circumstances to make a medical diagnosis of an illness or physical problem, or for prescribing or using drugs presented on the Site. In all instances you should refer to your physician or pharmacist.

Information, especially financial, published on the Site shall not be considered as an encouragement to invest. It should not under any circumstances be interpreted as prospecting or as a public offering, nor is it an offer to subscribe, buy or swap shares or other securities in DKSH and/or its affiliated companies. DKSH, draws your attention to the fact that financial information posted on the Site is regularly updated (if financial information is provided online).

Reporting an adverse event/side effect

Please note that your own healthcare professional is the best source of information regarding your health. If you are concerned about any of the side effects or you think you may have experienced a side effect, please inform your doctor or pharmacist because they are in the best position to advise you.

Where you provide personal data, including without limitation, your name, nick name, and contact details, to DKSH via the Site, such provision of your personal data is voluntary. Please review our Privacy Policy that explains your rights and our responsibilities with respect to personal data that is collected via the Site.

In accordance with applicable personal data protection laws and regulations, you have the right to access, update, or correct your personal data or limit or withdraw your consent to the processing of your personal data. Consequently, the act of sending it to us alone gives us the right to use it, reproduce it, publish it, alter it or send it with a view to dealing with your request.

Links to other sites

The liability of DKSH or of the DKSH Group shall not be incurred by a third party site that can be accessed via the Site. DKSH does not have any way of controlling the content of such third party sites which remain entirely independent of DKSH. Moreover, the existence of a link between the Site and a third party site does not under any circumstances mean that DKSH approves the content of that site or video in any way whatsoever and in particular the use that may be made of it.

In addition, you are responsible for taking the precautions necessary to prevent any infection from the Site, in particular by one or more computer viruses.

In any case, DKSH is not in any way liable for the non-availability of such sites and DKSH does not scrutinise, check or approve them and is not responsible for contents, advertising, products or other components available on or via those sites.

DKSH strives to the best of its ability to ensure that information published by DKSH on the Site is accurate and up-to-date. It reserves the right to correct or delete content at any time, without prior notice. Legal provisions and languages

The Site and its content are governed by the Laws of Malaysia, and any disputes relating thereto are subject to the jurisdiction of the courts of Malaysia.

Some of these terms and conditions are made in the English language and Malay language. The English text shall prevail in the event of divergence or uncertainty of meaning.
